HMARA Terms of Service

1. Acceptance of these terms

These Terms of Service (the “Terms”) are a binding agreement between you and Individual Entrepreneur Oleksii Khudenko, trading as HMARA (“HMARA,” “we,” “us,” or “our”), governing your access to and use of the HMARA mobile application and the website at https://www.hmara.care/ (together, the “Service”). By creating an account, opening the app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you are accepting these Terms on behalf of a child or another person in your care, you agree to these Terms on their behalf and remain responsible for their use of the Service.

2. Who we are

HMARA is operated by a single registered entity, not a company with separate legal personality. There is one operator responsible for the Service, for these Terms, and for how requests and complaints are handled.

3. The service

3.1 What HMARA provides

HMARA is an AI companion for emotional support and self-reflection. Through the app you can hold voice and text conversations with an AI system that can recall relevant context from your earlier conversations, choose the communication style the AI responds in, see personal insights drawn from your own conversations, and follow a wellbeing trend that reflects how things have been changing for you over time.

3.2 What HMARA does not provide

HMARA does not provide structured curricula, guided programs, or formal clinical evaluations. It does not employ, represent, or connect you with human therapists, counsellors, psychologists, psychiatrists, or any other licensed clinicians. It does not diagnose any medical or psychological condition, does not prescribe or recommend treatment, and is not a substitute for professional healthcare of any kind. Section 7 sets out the AI disclaimers, and Section 8 sets out why HMARA is never to be used as an emergency service, in full.

4. Eligibility and age

You must have the legal capacity to enter into a binding contract to use HMARA on your own behalf. A minor may use HMARA only with the involvement and authorization of a parent or legal guardian, and only where that involvement is sufficient under the law of the minor’s country — HMARA’s Privacy Policy explains, in detail, the age thresholds that apply to processing a child’s information and how a parent or guardian can review, correct, or request deletion of that information. HMARA is not intended for use by anyone below the minimum age reflected in the app-store listing for the country where the app was downloaded; the current age rating is shown on the App Store and Google Play listing pages for HMARA, and you should check it before allowing a minor to use the app.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating an account and to keep it up to date. 6. Subscriptions, trials, and payment

6.1 Auto-renewing subscriptions

Some HMARA features require a paid subscription. Subscriptions purchased through the App Store or Google Play automatically renew for a further period at the price and interval shown at the time of purchase, unless cancelled before the renewal date. Renewal is billed to the payment method on file with Apple or Google, not by HMARA directly.

6.2 Free trial and entitlements

HMARA may offer a free trial or a limited free entitlement to some features. Its exact length, scope, and eligibility are shown in the store listing and at the point of purchase, because those terms can change between store releases and a fixed number stated here would go stale. Once a trial period ends, a paid subscription begins automatically unless you cancel before it does.

6.3 Cancelling

You cancel a subscription through the subscription-management settings of the App Store or Google Play account used to purchase it, not inside HMARA. Deleting your HMARA account does not cancel an active store subscription — the two actions are independent, and you should cancel the subscription separately if you no longer want to be billed.

6.4 Refunds

Refund requests for a purchase made through the App Store or Google Play are handled by Apple or Google under their own refund policies, because HMARA does not process payment or hold your payment details directly.

7. Artificial intelligence and content disclaimers

All conversational responses, insights, and wellbeing trends you see in HMARA are generated by an automated AI system, not reviewed by a person before you see them. AI output can be incomplete, inaccurate, generic, or occasionally inappropriate to your specific situation. Nothing HMARA says is medical advice, psychological advice, legal advice, or crisis advice, and none of it should be treated as a diagnosis, a treatment recommendation, or a professional opinion of any kind. Use your own judgment, and consult an appropriately licensed professional for any decision that depends on accurate medical, psychological, or legal guidance.

8. Not a substitute for professional care; not an emergency service

HMARA is not a hospital, a clinic, a crisis-response service, or an emergency service, and it has no ability to see you, locate you, or dispatch help. If you or someone else may be in immediate danger, or you are experiencing a crisis, contact your local emergency services or an appropriate crisis line right away — do not rely on HMARA in an emergency. The Safety page lists verified crisis resources and explains what to do if you are worried about yourself or someone else; it is reachable from the footer of every page of this site.

9. Your data

Conversations and voice transcripts are processed to provide the Service to you. When you use voice mode, the original audio recording is discarded once it has been transcribed to text, and the transcript is what HMARA keeps as part of your conversation history. Your dialogues are not used to train HMARA’s own AI models or any third party’s general-purpose models. The Privacy Policy is the full and governing statement of how your information is collected, used, retained, shared, and protected, and of the rights and choices available to you, including the right to request deletion. You can request deletion of your account and associated data at any time through the Delete Account page.

10. Acceptable use

By using HMARA you agree that you will not:

  • use the Service for any unlawful purpose or in a way that violates applicable law;
  • abuse, harass, or attempt to harm HMARA, its operator, or other users through the Service;
  • attempt to extract, reverse engineer, or replicate the underlying AI model, prompts, or system instructions behind HMARA’s responses;
  • attempt to circumvent rate limits, subscription entitlements, or other technical or contractual restrictions on the Service;
  • rely on HMARA as a substitute for contacting emergency services or a qualified professional in a crisis or medical situation;
  • upload or submit content that is unlawful, infringes another person’s rights, or that you do not have the right to share.

HMARA may suspend or terminate access for a user who materially breaches this section.

11. Intellectual property and licence

Subject to your compliance with these Terms, HMARA grants you a limited, revocable, non-exclusive, and non-transferable licence to install and use the app for your own personal, non-commercial purposes. HMARA and its licensors retain all right, title, and interest in the Service, including the software, the HMARA name and brand, and the design and structure of the app and website — nothing in these Terms transfers any of that to you. You retain ownership of the content you submit to HMARA (for example, the messages you send), subject to the processing described in the Privacy Policy that is necessary to provide the Service back to you.

12. Availability and changes to the service

HMARA is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times, and features may be added, changed, limited, or withdrawn as the Service evolves. Where reasonably possible, we will give notice of a change that materially reduces the Service you rely on, but an emergency fix, a security measure, or a change required by a platform partner (Apple or Google) may need to take effect without advance notice.

13. Limitation of liability

To the maximum extent permitted by applicable law, HMARA and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of, or inability to use, the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including statutory rights available to you as a consumer under the law of your country of residence, which remain unaffected by this section.

14. Indemnification

You agree to indemnify and hold HMARA and its operator harmless from any claim, loss, or expense, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Service, or your violation of any law or of another person’s rights, to the extent permitted by applicable law.

15. Term, suspension, and termination

These Terms remain in effect for as long as you use the Service. You may stop using the Service at any time, and you may request deletion of your account through the Delete Account page. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service, and we will give notice where reasonably possible before doing so. Sections of these Terms that by their nature should survive termination — including intellectual-property ownership, limitation of liability, indemnification, and governing law — continue to apply after your access ends.

16. Governing law and dispute resolution

These Terms are governed by the law of Ukraine, without regard to its conflict-of-law principles. If you are resident in a country whose law grants you mandatory consumer-protection rights that cannot be displaced by a choice of governing law, this section does not remove or reduce those rights, and they continue to apply alongside these Terms.

17. Changes to these terms

We may update these Terms from time to time, for example to reflect a change in the Service, a legal requirement, or an app-store policy. A material change will be reflected in an updated effective date at the top of this document, and where reasonably practical we will give notice inside the app or on this website before the change takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
